Supreme Court Justice Clarence Thomas missed a third day of oral arguments Wednesday (March 23) as he remains hospitalized with what a spokesperson has described as an infection.

Thomas was checked into the Sibley Memorial Hospital in Washington D.C. on Friday (March 18) after having flu-like symptoms, CNN reported. He has not been on the bench all week.

The nation’s high court announced his hospitalization on Sunday (March 20) but has not provided any information about his condition. On Wednesday (March 23), the Supreme Court’s public information officer Patricia McCabe said there was “no update.”

“He underwent tests and is being treated with intravenous antibiotics,” McCabe said in a statement Sunday (March 20). McCabe clarified that Thomas was not diagnosed with Covid-19 at the time and added that his symptoms are “abating, he is resting comfortably and he expects to be released from the hospital in a day or two.”

Chief Justice John Roberts said that Thomas has been reading briefs and transcripts of oral arguments all week. All nine of the justices are vaccinated against Covid-19 and have received a booster dose, the outlet reported.
