The lawsuit filed in Cook County Circuit Court contends that 33-year-old Samuel Holmes was shot in the back several times as he ran from officers. According to the lawsuit, Holmes had fled into an alley when officers approached him after 10:45 p.m. on October 5 and was shot to death. A spokesman for the Chicago Police Department refused to comment on the lawsuit. But after the incident, authorities said shots were exchanged between Holmes and police.
