A federal lawsuit has been filed by the family of a man who was fatally shot by a Chicago police officer. According to authorities, 22-year-old Marcellus Perry was accidentally shot last Thursday when he struck a police officer during a foot chase through a gangway, causing the officer’s gun to discharge. Perry died the next day. Attorney Blake Horwitz said the family believes police aren’t being truthful. According to Horwitz, police stopped a car containing Perry and a friend for a traffic violation. He said after a short exchange between the two men and police, officers drew their weapons, prompting Perry and his friend to run. Horwitz said he believes evidence and witness testimony will show Perry was shot in the back of the head. The Independent Police Review Authority is investigating Perry’s death. ______ Copyright 2009 Associated Press. All rights reserved.
