CHICAGO (AP) — A woman who prosecutors say was raped as a child by a Cook County correctional officer is suing the Chicago suburb of Harvey.

Robert Buchanan was charged in September with predatory criminal sexual assault for the alleged rape of an 11-year-old in 1997. The 45-year-old Buchanan was charged after investigators obtained a DNA sample from him and linked it to DNA retrieved from the girl in 1997.

The sample was in a rape kit the Harvey Police Department failed to test.

The lawsuit contends the girl’s mother reported the abuse to Harvey police. It claims the abuse would have ended if the department investigated properly. The lawsuit doesn’t list the victim’s name.

Harvey spokeswoman Sandra Alvarado says police "diligently investigated" the allegation.
